John Plummer sues Duncan Bannatyne’s gym after injuring a tricep

An amateur body builder was hurt in a tumble at a gym, leading to a lawsuit for more than £200,000 against Dragon’s Den star Duncan Bannatyne’s club.

John Plummer, 58, claims that while warming up with a press-up on a slippery surface, he tore the tricep in his left arm.

This resulted in his elbow’s strength being permanently diminished, and he later developed melancholy, according to a writ filed in London’s High Court.

The Bannatyne Group plc’s insurance have acknowledged their responsibility for the accident that occurred on November 28, 2017, however the firm contests his claim for past and future damages and values his claim at…nil.

The High Court has now mandated that handyman Mr. Plummer provide his three-year earnings history as well as the whole of his medical, hospital, and treatment records.

Additionally, the case has been moved to the Newcastle-upon-Tyne County Court.

In his local Bannatyne’s gym, Mr. Plummer of Chester-le-Street, near Durham, claims the incident occurred while he was beginning a press-up as part of his warm-up while holding weights on the top tier of a three-level weight shelf.

He claims that he collapsed with all of his weight on his left arm when his legs unexpectedly slid on the damp floor. By failing to post warning signs, block off the area, or prevent him from exercising there despite the floor being wet, slippery, and hazardous, he charges the corporation of carelessness, exposing him to risk and “a trap.”

The costs of his treatment while travelling to Cambodia and the cost of a massage in the UK are included in his claim for damages.

According to his paperwork, he often travels throughout the winter months of December through March.

Although the fitness club acknowledges that its insurers recognised culpability in May 2018, it insists that Mr. Plummer show the kind and severity of his injuries as well as the expenditures associated with care, support, and medical attention, as well as his losses.

The fitness club disputes his financial assertions and values his lawsuit, which is worth a total of $229,363.93, at $0.

The court filings state that Mr. Plummer, whose girlfriend Michelle Thompson owns a hair salon, makes money from three rental properties and that, prior to the accident, he performed maintenance and other odd chores on them.

However, he claims that he had to hire contractors to complete the job since he injured his elbow.

Additionally, he asserts in the court documents that he had been considering competing in an over-50s body building competition but had to postpone those plans since he was unable to train as effectively at the gym after his injury.

The 73-year-old Mr. Bannatyne began his business career with an ice cream truck and went on to develop a network of nursing homes, a chain of children’s nurseries, and a chain of fitness clubs.

With 71 locations and dozens of spas, The Bannatyne Group is the biggest independent network of health clubs.

Between 2005 and 2015, he was a regular on the television show Dragon’s Den. He also participated in I’m a Celebrity.
