Marten and Gordon are charged with gross negligence manslaughter, 2 other offences

Constance Marten and Mark Gordon are set to appear in court charged with gross negligence manslaughter, concealing the birth of a child and perverting the course of justice.

The charges come after the remains of a newborn baby were found near a public footpath in an area not yet searched by police in Brighton on Wednesday.

Marten and Gordon were arrested in Brighton on Monday, ending a nationwide police hunt that began when they fled seven weeks ago with their baby.

However, the couple were without the newborn when officers arrested them. A post-mortem examination on the baby will take place later today.

Hundreds of mourners gathered to attend a vigil outside St Mary Magdalen Church in Coldean, East Sussex, close to where the baby’s remains were found.

The Crown Prosecution Service has authorised charges to be brought against Marten and Gordon, who will appear at Crawley Magistrates’ Court on Friday. The couple are also to be charged with concealing the birth of a child and perverting the course of justice.

Detective Superintendent Lewis Basford confirmed the case has been referred to the Independent Office for Police Conduct (IOPC) and that officers investigating the case are ‘devastated’ by its outcome.

He added that Marten and Gordon remain in custody, with the warrant for their detention extended until Thursday evening. The police are yet to confirm the infant’s gender, and it is too early to provide a specific date of death.
