Judgement on Bail Applications of Accused Helping Serial Rapist Thabo Bester to be Announced in Bloemfontein Court

Judgement on Bail Applications in Thabo Bester Case to be Delivered

The Bloemfontein Magistrate’s Court is set to deliver its judgement on the bail applications of five individuals accused of assisting serial rapist Thabo Bester in escaping from prison.

The judgement will be announced on Monday afternoon, 29 May.

Defence Lawyers Argue for Bail Based on Non-Interference and Family Responsibilities

The lawyers representing the accused, Senohe Matsoara, Teboho Lipholo, Motenyani Masukela, Tieho Makhotsa, and Nastassja Jansen, presented arguments for their release on bail.

They emphasized that the accused would not tamper with witnesses or attempt to evade trial.

Additionally, it was mentioned that some of the accused individuals are the main providers for their families.

State Prosecutor Opposes Bail, Citing Potential Damage to Public Confidence

However, State Prosecutor Sello Matlhoko contended that, apart from Jansen, who faces lesser charges, none of the accused presented evidence to demonstrate that their release on bail would serve the interests of justice.

Matlhoko asserted during the closing arguments that granting bail to the accused would undermine public trust in the police and the justice system.

Bail Decision to be Announced on Monday

The court is expected to announce its decision on bail at midday on Monday.

Future Court Proceedings and Status of Other Defendants

Apart from the five individuals seeking bail, the remaining defendants, Thabo Bester, Dr Nandipha Magudumana, and Zolile Cornelius Sekeleni, will also appear in the same court on 20 June for the continuation of the main criminal case.

Sekeleni was previously granted bail of R10,000 several weeks ago.

Magudumana opted not to apply for bail and is currently challenging the legality of her arrest and detention.

Meanwhile, Thabo Bester, the convicted rapist and murderer, remains incarcerated at Kgosi Mampuru II in Pretoria.
