Santa Fe District Attorney responds to Alec Baldwin

The Santa Fe District Attorney, Mary Carmack-Altwies, has responded to Alec Baldwin’s attempt to dismiss the special prosecutor in his US court case.

Baldwin’s lawyers filed a motion last month claiming that special prosecutor Andrea Reeb’s involvement in the case was “unconstitutional” due to her elected position in the New Mexico House of Representatives.

They argued that this violated the state constitution’s separation of powers provision and that Reeb could make prosecutorial decisions that serve her legislative interests.

In response, the DA stated that the motion was based on a “novel theory that has no support in New Mexico statutes or case law.”

According to the filing, the state constitution provides safeguards against legislators interfering with ongoing court cases, and any attempt by Reeb to influence the outcome of the trial would be completely ineffective.

The DA also stated that disqualification of a special prosecutor on constitutional grounds is a severe remedy that cannot be supported by “imaginative but unsupported theories” set out by the defendant’s motion.

The case involves Baldwin facing two charges of involuntary manslaughter over the fatal shooting of Rust cinematographer Halyna Hutchins, to which he has pleaded not guilty. A status hearing in the case is scheduled for March 9th.
