Renowned constitutional lawyer, Dr. Kayode Ajulo, has called upon the Department of State Services (DSS) to uphold the rule of law during the prosecution of the suspended Chairman of the Economic and Financial Crime Commission (EFCC), Abdulrasheed Bawa, and other individuals.
In a statement, Ajulo pleaded with the DSS to refrain from infringing upon the fundamental rights of Bawa and those in its custody.
Unlawful Detention Concerns
Ajulo argued that it is unlawful to excessively detain Bawa beyond the stipulated time permitted by the law.
He specifically appealed to President Bola Tinubu to intervene and caution the security agency, emphasizing the importance of upholding the rule of law.
Failure to Comply with Constitutional Provisions
Ajulo highlighted that the failure of the Muhammadu Buhari-led administration to comply with constitutional provisions concerning unlawful detention has been one of its fundamental shortcomings.
He stressed that in a just and law-abiding governance system, the rights of individuals and citizens should be paramount, and any actions to rectify misconduct should strictly adhere to legal provisions.
Advocate for Rule of Law
While acknowledging that he is neither a friend nor a supporter of the embattled former EFCC Chairman and his administration, Ajulo made it clear that his advocacy is solely driven by his commitment to the rule of law.
He expressed his belief that the ongoing detention of Bawa by the State Security Services is unlawful, alarming, and a violation of his Right to Personal Liberty as guaranteed by the Constitution.
Previous Concerns and Dissent
Ajulo further stated that he has consistently voiced his dissent and raised concerns about the defective administration of certain government agencies, particularly the EFCC, which is headed by the suspended chairman.
He cited instances of unjust treatment and insufficient regard shown by the Commission and its staff toward visitors and accused individuals, including legal practitioners.
