A man accused of raping LSU student Madison Brooks and a 12-year-old girl has been charged with a third rape — the sexual assault of a woman he met at the same club that Brooks frequented before being struck and killed by a vehicle.
The Advocate said that Kaivon Washington, 18, assaulted the victim woman he and Karson Jones met in August 2022 in the parking lot of Reggie’s pub in East Baton Rouge.
According to court documents quoted by the publication, the victim asked Jones, a former acquaintance of hers, whether she could overnight at his home because she was too inebriated to drive.
According to the records, after the woman had sex with Jones, who grew aggressive, pinned her down, and refused to stop, Washington allegedly “joined the act” by touching her.
Both Washington and Jones were charged with aggravated rape.
The victim provided authorities with text texts from Washington in which the suspect apologized for touching her and placed the blame on Jones for drawing his hands toward her.
A day after being freed on bond for the third-degree rape of Brook, Washington was charged with the first-degree rape of a 12-year-old child in May or June 2020. In that case, Washington was accused of committing a 30-minute rape on the kid after she left a birthday party in Livingston Parish to go swimming at an apartment complex.
Washington’s attorney, Ron Haley, raised “numerous concerns” over the most recent charge, including the fact that the inquiry began around five months after the incident.
“First, similar to the Livingston incident, the ‘follow-up’ investigation occurred on or around 1/25/23. Second, the incident date on Mr. Washington’s warrant is different from that of his co-defendant, he said WAFB.
“Finally, the arrest warrant for his co-defendant contains no reference of intoxication. It states that the victim was engaging in consensual sexual activity with his co-defendant while Mr. Washington was present,” Haley wrote.
“Finally, the victim never accused Mr. Washington of having sexual relations with her, so it is puzzling why he was charged with rape,” he continued.
Haley has also cited the timing of a witness’s statement to investigators that she witnessed Washington enter a room with the 12-year-old girl.
Last month, he stated, “Mr. Washington and his mother cooperated with the investigation two years ago, but law enforcement took no action.”
Haley continued, “Upon review of the new statement made by a witness yesterday, we are concerned not only about the timing of this statement, but also whether it meets the threshold for probable cause.”
After a night of drinking at Reggie’s, Washington and a 17-year-old boy have been charged with raping Brooks in the back of a car, while Everett Lee, 28, and Casen Carver, 18, have been charged with seeing the alleged assault but not participating.
One day after being released on bond in the Madison Brooks case, Washington was further charged with a rape.
Brooks, who police say had a blood-alcohol level of 0.319%, four times the legal limit, was ejected from the vehicle and, after wandering onto a street, was tragically struck by another vehicle, according to officials.
None of the accused are current LSU students.
