In Fulton County, a surveillance video emerged, capturing Ruby Freeman seemingly involved in suspicious activities after polls closed. The video depicted her taking suitcases from under tables and stuffing ballots into machines.
However, closer examination revealed that the so-called “suitcases” were official ballot containers, and the alleged “double-counted” ballots were only counted once. The apparent “smoking gun” video that fueled voting fraud claims turned out to showcase normal ballot counting.
Debunking Conspiracy Theories
State and federal investigators swiftly debunked the conspiracy theory triggered by the State Farm Arena surveillance video in 2020. Despite the debunking,
Donald Trump continued to amplify the video as a central piece in his campaign to overturn the election in Georgia. Documents reviewed by The Atlanta Journal-Constitution indicated that some members of Trump’s own team were aware of the dubious nature of the voting fraud claims.
Legal Consequences for Giuliani
In August, Federal Judge Beryl A. Howell entered a default judgment, finding Rudy Giuliani liable for defamation, intentional infliction of emotional distress, civil conspiracy, and punitive damage claims.
The judgment required Giuliani to cover the attorney’s fees for Ruby Freeman and her daughter, who sued him for falsely accusing them of election fraud.
The subsequent jury trial resulted in Giuliani being ordered to pay $75 million in punitive damages, $33 million in compensatory damages, and $40 million for intentional infliction of emotional distress.
Trump’s Involvement and Indictment
One prominent Trump adviser dismissed the claims related to the video as “conspiracy s— beamed down from the mothership.” Trump’s persistent claims about the video now play a central role in a 45-page federal indictment.
The indictment accuses the former president of engaging in an illegal scheme to overturn Joe Biden’s victory by using knowingly false claims of election fraud to influence state legislators and election officials.
Legal Action by Freeman and Moss
Ruby Freeman and her daughter, who actively participated in the 2020 election, took legal action against Giuliani in 2021 for his role in falsely accusing them of election fraud.
At the time, Moss worked full-time at the Fulton County Elections Department, while Freeman volunteered for the vote count.
