Nick Kyrgios will ask for the dismissal of his assault allegation because of mental health issues.
In ACT Magistrates Court on Tuesday, the tennis player’s attorneys requested a postponement so that forensic mental health reports could be created.
They will next submit an application according to a provision of the local crimes legislation to have the case dismissed.
The law allows magistrates the authority to drop a case if they believe an accused person suffers from a mental impairment and that doing so would be in the best interests of both the offender and the community.
The alleged incident in January 2021, which was reported to ACT police in December, is the subject of the common assault accusation.
According to reports, the indictment has to do with a situation involving his ex-girlfriend Chiara Passari.
According to Kyrgios’s attorney Michael Kukulies-Smith, who cited a number of public remarks made by the world No. 20 tennis player, the application was reasonable given the tennis star’s mental health history since 2015.
Kyrgios requested a personal appearance at the application hearing, according to the court.
To set up a time for the hearing, the issue was stood down.
