The 22-year-old guy who was arrested for allegedly running down and badly injuring dozens of Los Angeles sheriff’s recruits with his SUV has been released from jail to allow authorities to gather more evidence.

CNN reported that Nicholas Joseph Gutierrez, who was charged with attempted murder of a peace officer, was freed at 9:49 p.m. Thursday based on jail records citing an insufficient complaint.

Deputy Deanna Mares of the Los Angeles County Sheriff’s Department told the network that Gutierrez was released because detectives need more time to gather evidence for the District Attorney’s office.

Mares told CNN, “It’s not as if they arrested the incorrect individual.” They only wish to ensure that the probe will be exhaustive.

Due to the sheriff’s office not being prepared to bring the case to the DA, Gutierrez was released.

She added that the Sheriff’s Department is required to deliver a case to the DA within 48 hours following an arrest, but the investigators were not prepared to do so with Gutierrez.

According to the Los Angeles Times, his original arrest was declared a detention. According to the documents, the California Penal Code permits police to release detainees without arraignment if there are insufficient grounds to file a criminal complaint.
