Harvey Weinstein will not face a retrial for the charges relating to two of his accusers after a hung jury last December, Los Angeles prosecutors have said.
Weinstein was sentenced to 16 years in prison for the charges of rape and sexual assault relating to Jane Doe 1, an Italian model he encountered in February 2013 at the Mr. C Hotel in LA. However, the jury could not reach a unanimous verdict on the charges relating to Jane Doe 2, identified as actress and screenwriter Lauren Young, and Jane Doe 4, Jennifer Siebel Newsom, the wife of California Gov. Gavin Newsom.
Deputy District Attorney Paul Thompson confirmed that prosecutors decided not to seek a new trial against Weinstein on the remaining counts.
Thompson said that Jane Doe 4 submitted a statement to the judge saying that she didn’t want to seek a retrial, while Jane Doe 2 was disappointed with the decision dismissing the remaining charges.
Thompson said that if Weinstein was convicted on the sexual battery charge relating to Jane Doe 2, he would have faced only another year in prison, and many of the same witnesses would have had to testify again, including one who would have had to testify for the fourth time.
Weinstein’s spokesman Juda Engelmayer said that the dismissal of the charges is “an important step towards Harvey Weinstein’s appeal in LA.” Engelmayer claimed there is “ample support and proof” to support Weinstein’s claims that the incident with Jane Doe 1 “never happened and he didn’t know or meet this person.”
Weinstein’s lawyer Jacqueline Sparagna told The Post that Weinstein would likely be transferred back to New York, where he is serving a 23-year prison sentence on a rape and sexual assault conviction, within “days”.
The 70-year-old disgraced movie mogul currently has an appeal of his New York conviction pending in the state’s highest court.
