Fiona Hoyle receives a suspended jail sentence after she was convicted of affray and actual bodily harm at Portsmouth Crown Court

Teenage sports shop employee who assaulted a woman and knocked her unconscious in a drunken altercation after her buddy grabbed a man’s bottom after a night out escaped jail.

Kealey Smith, a fellow club patron, was assaulted by Fiona Hoyle who punched, pulled out her hair extensions, and stamped on her, leaving Kealey Smith bruised from head to toe and unconscious.

The vicious incident started when Miss Smith’s pals and the “violent” 19-year-old Hoyle got into a fight in the street outside a bar.

In front of his partner, Hoyle’s friend and beauty therapist Scarlett Bareham allegedly grabbed the bottom of one of Miss Smith’s male pals, causing a 2 am scuffle to break out.

Hoyle, a high street retail employee, has now received a suspended prison sentence for her participation in the ensuing altercation.

In connection with the altercation outside Mr. Miyagi’s bar in Portsmouth, Hampshire, in August 2020, she admitted charges of affray and actual bodily injury.

Hoyle, Bareham, and a third friend were leaving a nightclub in the city when the fight broke out, according to testimony presented before Portsmouth Crown Court.

According to Gareth Burrows, the prosecutor, Miss Smith, now 21 years old, and her pals left Mr. Miyagi’s pub at around two in the morning because it was closing and they had made the decision to wait for an Uber to take them home.

According to testimony given in court, Bareham grabbed one of Miss Smith’s male friends’ bottom as they were waiting.

Miss Smith added, “He has a girlfriend, you can’t do that,” Mr. Burrows said.

Miss Hoyle replies that she didn’t care and leaves it at that. Well, you should, adds Miss Smith.

Miss Smith remarked, “I believe she intended to hurt me, she hit the left hand side of my face from my jaw line to my neck.” Miss Hoyle then delivered a powerful blow to the face.

‘ She said Miss Hoyle was “ripping my extensions out of my head” as she punched her and pulled her hair with one hand while punching her with the other.

She stumbled to the ground, passed out, and became asleep. Miss Hoyle and others may be seen repeatedly stamping and kicking down toward Miss Smith while they are on the ground.

According to testimony given in court, Hoyle, of Portsmouth, also shoved and assaulted Miss Smith’s boyfriend before being restrained by on-site door security as she was being brought to the hospital.

Despite the fact that I was in a lot of agony at the time, Miss Smith added, “This crime has hurt me more emotionally than physically.” I had bruises all over my body.

Knowing I had bruises on my face and torso, I was too ashamed to leave the house. I had a concussion and had to spend the next few days in bed.

“I’ve grown much more fearful of leaving the house.” I’m afraid of what one of these gals could do to me if we cross paths again.

“I have a feeling that they wouldn’t think twice if they saw me again.” They might damage someone else even more severely if they do this to someone else.

The defense attorney, Edward Hollingsworth, said that Hoyle had changed her life following a “tough” background as one of ten children raised by a single mother. She now works for the sports retailer JD Sports.

She was inebriated, it was tossing out hour at the pubs, and she got into a fight and acted violently, the man claimed.

She really regrets what she did, as well as the terror, hurt, and suffering she inflicted on Miss Smith.

Judge David Melville QC suspended Hoyle’s one-year prison term for two years.

“You got much too drunk, got into a fight, punched a completely innocent woman, then kicked her when she was on the ground,” he stated.

“You attacked an innocent woman and seriously hurt her.”

Although the behavior was abhorrent, it happened two years ago, and you have since found a way to change your life.

The judge further stated: “If you are inclined to commit any other criminal offenses in those two years, think again.” Hoyle was also had to do 75 hours of unpaid work and 30 days of rehabilitation.

If you commit any other offenses, a judge may declare that you have already had your opportunity and sentence you to prison.

In relation to the bottom grab, Bareham was initially charged with sexual assault; however, because there was insufficient evidence, the charges were withdrawn.

She did, however, admit to kicking and punching Mark Palmer, a fellow patron at the club who had gotten engaged in the altercation.

After entering a plea of guilty to affray at Portsmouth Crown Court at the end of last year, she was given a sentence of 100 hours of community service and told to pay Mr. Palmer £150.

Hannah Phillips, a friend of Hoyle and Bareham, was initially charged with sexual assault for slapping the man’s bottom but was later cleared after agreeing to a conditional caution.

For a second incident in December 2020, when she was seen with a group of people outside a building of apartments in Havant, Hampshire, “all shouting things like slut, come on, fucking prick,” Hoyle also pleaded guilty at the most recent hearing to a third charge of affray, possession of a knife, and possession of an offensive weapon.

With a knife in one hand and a piece of fence paneling in the other, Hoyle was shown on camera sprinting into the apartment building.

Abdou Touray, a native of Portsmouth, and Reiss Jones, a resident of Havant, were both seen carrying guns.

Touray, 20, was sentenced to a nine-month prison term with a two-year suspension, 30 days of rehabilitation, and 100 hours of unpaid work after pleading guilty to counts of assault and possession of an offensive weapon.

Jones, 21, admitting to having a knife, an offensive weapon, and engaging in a fight. He received a one-year prison term with a two-year suspension, 100 hours of unpaid labor, and a requirement to participate in a thinking skills program.
