An ACT court has heard that there is “no legal basis” for the prosecution to play Brittany Higgins’ six-hour pre-recorded interview with Network Ten’s The Project.
Shane Drumgold, the Director of Public Prosecutions for the ACT, told the ACT Supreme Court on Wednesday that he would not use the interview as evidence during the trial of the man accused of sexually assaulting the victim.
Bruce Lehrmann has pled not guilty to unconsented sexual contact.
The prosecution informed the court that the six-hour pre-recorded interview between Network Ten’s The Project and Brittany Higgins (pictured) will not be used as evidence because it had “any legal basis.”
Chief Justice Lucy McCallum informed the court that the nature of the case will be ‘word against word,’ with both parties striving to establish their trustworthiness before the jury.
Additionally, Lehrmann’s attorneys are attempting to collect records from the Australian Federal Police, with a decision regarding which material will be turned over scheduled for next week.
After raising concerns about the directness of several questions asked during interviews, the prosecution is determining whether it needs to delete portions of audio evidence prior to the trial.
The queries began with the phrase, “Could you please explain why…”
The trial will commence on October 4.
