Attorney General says schools with solely ‘gender neutral’ bathrooms are illegal

Attorney General claims that schools that solely provide “gender neutral” restrooms are against the law.

Suella Braverman, the Government’s main legal adviser, has said that schools have a responsibility to provide kids with “single-sex restrooms.”

She has also criticized schools for “transitioning youngsters behind their parents’ backs” and called it a “major intervention” to refer to transgender children by their chosen pronouns.

Ms. Braverman made these observations in preparation for a lecture she will deliver later today at the Policy Exchange think tank, in which she will outline the Government’s recommendations for how schools should treat transgender students.

The Attorney General wrote in today’s Telegraph that schools may prohibit biologically and legally male children who identify as transgender from accessing girls’ restrooms.

She said, “There is also a distinct need to offer single-sex restrooms in schools, the violation of which is illegal.” Consequently, due to the legal context, biological male youngsters are often not authorized to use the female restrooms at schools.

She said that schools that’socially transfer’ children without parental agreement may violate their duty of care and be subject to legal action.

Ms. Braverman will state that instructors should not refer to transgender students by their chosen pronoun unless instructed to do so by a medical practitioner.

Former Equalities Minister Kemi Badenoch, who joined the contest for Conservative leader with Ms. Braverman, said earlier this year that youngsters ‘avoid’ using gender-neutral restrooms in schools.

Women’s rights organizations have long contended that gender-neutral restrooms with urinals and cubicles disadvantage women.

The Home Office, BBC, and Channel 4 all have gender-neutral facilities in their workplaces.

In October 2019, the Old Vic theatre updated its men’s and women’s restrooms with “self-selection” facilities that may be used by all genders.

In the last four years, NHS hospitals have reportedly spent over £800,000 on gender-neutral restrooms.

Since 2018, the TaxPayers Alliance (TPA) collected data indicating that roughly 740 additional unisex toilets had been constructed or retrofitted, including during the Covid epidemic.

Mersey Care NHS Foundation Trust in Merseyside spent almost £586,000 on 63 gender-neutral restrooms alone.

The NHS’s controversial child Tavistock transsexual clinic will close after a scathing investigation determined it was ‘not safe’ for youngsters. This was disclosed last month.

The Tavistock & Portman NHS Foundation Trust’s gender identity service will be replaced with regional centres at existing children’s hospitals.

In response to an ongoing evaluation conducted by leading paediatrician Dr. Hilary Cass, who cautioned that the gender clinic was “not a safe or practical long-term alternative,” this decision has been made.

When children were sent to Tavistock’s Gender Identity Development Service, she discovered that other mental health concerns were “overshadowed” by gender identity difficulties (GIDS).

Former patients who felt they weren’t sufficiently pushed have accused the clinic of pushing youngsters into puberty-blocking medicines.

Dr. Cass has advocated for “rapid” medication development after discovering “insufficient proof” of their advantages.

NHS England announced that it will establish two new centres in London and the North West to be operated by specialized children’s hospitals.

They will assume responsibility for all Tavistock child transgender patients and waiting lists in an effort to close the clinic by spring of next year.
