He stated that a prohibition would cause him and his 57-year-old father extreme suffering.

The official masseur of retired world heavyweight champion Tyson Fury was spared a driving penalty after explaining to a court that he needed his vehicle to continue treating the boxer.

Matthew Towey, age 27, risked disqualification under the totting up procedure when he was spotted texting while driving his Ford Fiesta through a police station while in violation of the totting up procedure.

However, the businessman preserved his license under ‘extreme hardship’ restrictions, arguing that losing it would place his dependant 57-year-old father in a precarious situation.

He further asserted that his massage business would fail because he used his vehicle to visit the houses of renowned clients, including Manchester United striker Scott McTominay and boxer Billy Joe Saunders.

According to reports, Gypsy King Fury is planning a comeback bout against the Ukrainian Oleksandr Usyk, who defeated Anthony Joshua last month.

Towey had nine points on his license when he was spotted on his mobile phone by a uniformed officer outside the Speke police station in Liverpool on July 3, 2020, according to the Wirral magistrates court.

PC Merseyside Police Officer Lindsey Davis stated, “His eyes were not on the road.” The subject of his gaze was the mobile phone carried in his right hand.

As he drew level, his cell phone was clearly visible and his thumb was moving over the screen as if he were messaging.

Towey (shown with Tyson Fury) stated that he would be unable to continue working as a sports therapist if he lost his license, as he travels to his customers’ houses.

“I was astounded that the driver had not noticed me. I was very visible.

He was concentrating on where he was going, but he was looking up rather than at the road. I was concerned about his proximity to a school.

I am aware that lockdown was in effect, but since he did not see me, he would not have spotted anyone rushing into the street.

Towey, from Speke, was convicted of using his cell phone while driving.

During the hearing, he stated, “I have also worked with professional athletes, including world heavyweight boxing champion Tyson Fury, Manchester United footballer Scott McTominay, and several other boxing world champions.”

Towey (shown with Noel Gallagher) argued that a driving restriction would cause exceptional hardship for his 57-year-old dependant father.

Towey (shown with Tyson Fury’s brother, Tommy Fury) got nine points on his license when he was caught using a cell phone.

He stated that he drove approximately 20,000 miles each year and that, because to Covid, he has only been able to expand his firm “slowly but steadily” over the past year.

He stated that if he lost his license, he would be unable to continue working as a sports therapist, as he visits his clients in their homes.

When asked what he would do instead, he responded, “I’m not entirely certain.” I would need to obtain employment of some sort.

When questioned if he had any dependents, he stated that his 57-year-old father, Paul Towey, who lives alone in Speke, is.

Towey stated, “He has a driver’s license, but he shouldn’t drive owing to his medical concerns.”

He suffers from a range of ailments. Due to his heart failure, he has fluid on his lungs. He has osteopenia and four fractures in the upper back region.

His medical concerns also cause him to suffer from depression. Due to the accumulation of fluid on his lungs, he must frequently visit the hospital to have them drained, or he could perish.

He must visit the hospital every three to four weeks. I take him to the Liverpool Heart and Chest Hospital or occasionally to St. Helens.

The magistrates accepted his claim of exceptional hardship, allowing him to continue driving with 15 points on his licence.

Adding that he brings his father out for his mental health, he stated, ‘I see him every day.’ I clean for him, cook for him, take him shopping, and transport him to the hospital when necessary. Additionally, I collect his medication from the West Speke Health Centre.

“Without a salary, I would be unable to afford the daily commute to see my father. He would have to take a taxi to the hospital, which would be difficult for him to finance.

Towey replied that he had not looked into medical transportation for his father when asked by the magistrates.

He stated that his sister lives in Australia and his brother lives in Whitby, with no other family members available to assist.

The magistrates accepted his case of exceptional hardship, allowing him to continue driving with 15 points on his license.

Judicial officers advised him, “The bar is intentionally set fairly high for these exceptional hardship cases.”

Regarding your circumstances, we are of the opinion that your father would endure extraordinary suffering if you were to lose your license. He depends on you to transport him to the hospital and care for him.

Towey was also ordered to pay a $150 fine and $234 in expenses and victim surcharge.

Since 2019, Towey has collaborated with Tyson Fury after being introduced by boxer and buddy Isaac Lowe.

According to Towey’s LinkedIn page, he has also represented boxer Billy Joe Saunders and “many more top-level sportsmen and boxers.”

‘We’ve also evaluated the impact on your firm, and based on the viability of your company and the fact that it was founded in the current economic situation, we believe that you would experience severe hardship as well.

‘We have also received a letter from your physician and are aware that if you were to lose your employment, you might experience some emotional distress.

“On this premise, we will permit you to keep your license today. You will receive six points on your driving record.

If you are convicted of another offense during the next three years, you will no longer be allowed to cite hardship as a defense and you will likely lose your license.

Towey was also ordered to pay £150 in fines and £234 in costs and victim surcharge.
