Charity Commission has opened an inquiry into Devon and Cornwall Autistic Community Trust, also known as ‘Spectrum’

Following multiple extremely severe inspections of the charity’s facilities by the Care Quality Commission, the regulator is worried that the trustees may have neglected to carry out their legal obligations and responsibilities under charity law (CQC).

Five of the charity’s adult care facilities were deemed inadequate by the CQC, while eight were determined to need improvement.

The trustees have not taken the necessary steps to resolve all of the issues brought up by the CQC.

Regulators are now concerned about how the charity’s trustees are running things.

The Commission’s probe will look into possible instances of misconduct and/or poor management in the charity’s management and governance.

The investigation will look at:

The trustees’ response and choice-making process in light of the safety issues brought up by statutory or regulatory organizations.

Whether the trustees had complied with and performed their responsibilities under the law governing charities, particularly with relation to having enough control of the safeguarding measures implemented by the organisation.

If new issues surface, the Commission may broaden the scope of the investigation.
